1.Acceptance of Terms

These Terms of Service (the "Terms") form a legally binding agreement between you ("you", "your", "User", or "Customer") and Atlas Gateway ("Atlas Gateway", "we", "us", or "our"), the operator of the website located at atlasbrain.cloud and any related domains, APIs, dashboards, or services (collectively, the "Service").

By accessing, browsing, or using the Service in any manner — including but not limited to creating an account, generating an API key, making a request through our API, signing in with a third-party identity provider, completing a payment, or simply visiting our public pages — you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy, each of which is incorporated by reference.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms.

Binding Agreement These Terms are a legal contract. By using the Service, you affirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and are fully able and competent to enter into a binding agreement. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, in which case "you" refers to that organization.

2.Description of Service

Atlas Gateway provides a unified API proxy layer that routes artificial intelligence inference requests from customers to various third-party artificial intelligence model providers (each a "Provider"), including but not limited to OpenAI, Anthropic, Google, DeepSeek, Zhipu AI, and others. We aggregate, normalize, and forward requests to the requested model on behalf of the customer, handle authentication, rate-limiting, usage metering, billing, and provide a dashboard for monitoring usage and managing API keys.

The Service is provided on a software-as-a-service (SaaS) basis. We do not own, develop, train, or directly control the underlying AI models made available through the Service. We are a routing and management layer only.

3.Eligibility & Account Registration

To use the Service, you must:

Account registration is performed via Google OAuth. By signing in, you authorize us to receive your basic Google account profile information (name, email address, profile picture URL) in accordance with our Privacy Policy. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4.API Keys, Security & Responsibility

Upon registration, you will be issued one or more application programming interface keys (each, an "API Key"). Your API Key is a secret credential. You are solely responsible for:

You may create multiple API Keys subject to your tier's limit (Free: up to 3 keys, Pro: up to 5 keys, Premium: up to 10 keys). You may label, rotate, and revoke your API Keys at any time via the dashboard. Revocation is permanent and immediate; a revoked key cannot be recovered.

We are not responsible for any loss, damage, cost, or expense arising from your failure to safeguard your API Key or from unauthorized use of your API Key, except where such loss is caused by our gross negligence or willful misconduct.

5.Subscriptions, Billing & Auto-Renewal

Access to certain features of the Service — including elevated rate limits, access to premium models, and removal of advertising — requires a paid subscription. The currently available subscription tiers are:

Subscriptions are processed through one of the following payment channels at your election: (a) Paddle (for credit/debit cards, Apple Pay, Google Pay, and other card-based methods), (b) NOWPayments (for cryptocurrency, including but not limited to USDT, BTC, and ETH), (c) EasyPaisa (for Pakistan-based bank/wallet transfers), or (d) JazzCash (for Pakistan-based bank/wallet transfers).

Auto-Renewal. All paid subscriptions automatically renew at the end of each billing cycle for an additional period of the same length, at the then-current price, unless and until you cancel your subscription. By purchasing a subscription, you authorize us (or our payment processor) to charge your selected payment method for the recurring subscription fee.

Price Changes. We may change subscription prices at any time. Price changes take effect at the start of your next billing cycle following at least 30 days' notice via email and an in-dashboard banner. Continued use of the Service after a price change takes effect constitutes acceptance of the new price. If you do not accept a price change, you may cancel your subscription before the change takes effect.

Taxes. Subscription fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. You are responsible for paying all such taxes associated with your use of the Service, except for taxes on our net income.

6.Free Tier, Bonus Requests & Promotional Credits

The Service provides a free tier (the "Free Tier") that allows limited use of the API at no charge, subject to the rate limits described in your dashboard. The Free Tier is intended for personal, non-commercial exploration, evaluation, and development.

We may, at our sole discretion, award you additional bonus request credits through various mechanisms, including but not limited to: (a) daily login bonus, (b) watching an advertisement, (c) completing a shortener link, (d) entering a promotional code, (e) participating in a randomized promotion, or (f) referring new users.

Anti-Abuse & Right to Revoke Bonus credits, promotional credits, daily bonuses, and referral rewards are not property, carry no cash value, and may be revoked, adjusted, or invalidated at any time in our sole discretion, including (but not limited to) in the event of: suspected fraud, automated/abusive behavior, multi-account abuse, chargeback fraud, or violation of these Terms. We may also modify, suspend, or discontinue any bonus program at any time without prior notice.

7.Acceptable Use Policy

You agree not to use the Service to:

  1. Violate any applicable local, state, national, or international law, regulation, or treaty.
  2. Infringe the intellectual property rights, privacy rights, or any other rights of any third party.
  3. Generate, transmit, store, or facilitate the distribution of content that is illegal, harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  4. Generate or distribute content that depicts or exploits minors in any sexual or exploitative manner, including child sexual abuse material (CSAM).
  5. Use the Service to develop, train, or improve any artificial intelligence model, machine learning system, or similar technology, whether for commercial or non-commercial purposes, without our express prior written consent.
  6. Perform automated, bulk, or scripted requests at a rate that exceeds your tier's documented rate limits, or that we reasonably believe constitutes an attempt to circumvent rate limits, abuse bonus systems, or disrupt the Service.
  7. Resell, sublicense, white-label, or otherwise commercially redistribute the Service or any output of the Service, in whole or in part, except with our express prior written consent.
  8. Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying algorithms, or non-public components of the Service.
  9. Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, or any related systems or networks.
  10. Use the Service for spam, phishing, social engineering, malware distribution, denial-of-service attacks, or any other malicious or deceptive activity.
  11. Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure or interfere with any other party's use of the Service.
  12. Attempt to use automated means (bots, scrapers, crawlers) to access the Service for any purpose other than legitimate, rate-limited API requests, except with our express prior written consent.
  13. Misrepresent your identity, impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  14. Use the Service in connection with the operation of nuclear facilities, aircraft navigation, air traffic control, life-support machines, weapon systems, or any other activity where the failure of the Service could lead to death, personal injury, or severe environmental damage.

We may investigate violations of this Acceptable Use Policy and may involve and cooperate with law enforcement authorities in prosecuting users who violate the law.

8.Content, Data & Intellectual Property

Your Content. You retain all right, title, and interest in and to the prompts, inputs, and other content you submit to the Service ("Your Content"), as well as the AI-generated outputs returned to you in response to Your Content ("Outputs"), to the extent permitted by applicable law and by the terms of the underlying Providers.

License to Us. You grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, store, transmit, modify, and process Your Content solely as necessary to (a) provide the Service to you, (b) enforce these Terms, (c) prevent fraud, abuse, or security incidents, and (d) comply with applicable law. This license terminates when you delete your account and we have completed the deletion of Your Content, except where retention is required by law or legitimate business purpose (e.g., billing records).

Use of Content for Service Improvement & Model Training. To operate and improve the quality of the Service — including training, fine-tuning, calibrating, and evaluating our own answer-quality and routing systems (such as the Atlas Alloy deliberation system) — you agree that we may log, store, and process the prompts and other inputs you submit through the Service and the Outputs returned in response (together, "Improvement Data"). Improvement Data is stored keyed to a pseudonymous account identifier (a one-way hash — not your name, email, or API key), is retained only as long as needed for the purposes above, is never sold, and is never shared with third parties other than the data-storage processor that hosts it on our behalf (see the Privacy Policy). We do not provide Improvement Data to the third-party model Providers, and we do not use it to train any third party's models. Where we have a good-faith reason to suspect fraud, abuse, or a violation of these Terms, authorized administrators may review the Improvement Data associated with the account under investigation in order to investigate and enforce these Terms; every such review is internally logged.

Per-Request Opt-Out You can exclude any individual API request from Improvement Data collection by including "store": false in the JSON request body. Excluded requests are processed normally and their prompt and output content is not retained for improvement or training purposes. Details in the Privacy Policy.

Quality Signals. In addition, we collect anonymized quality signals derived from your use of the Service — routing decisions, automated quality scores, agreement and confidence metrics, latency, error categories — and, where you choose to use feedback controls (opt-in by use), your ratings of answers, in each case to operate, calibrate, and improve the Service. Ratings may be joined to the stored Improvement Data record of the answer they rate. Our underlying Providers may have their own data-handling practices; we encourage you to review their respective terms and policies.

Feedback. If you provide us with any feedback, suggestions, or ideas regarding the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use such feedback for any purpose without restriction or compensation to you.

9.Service Availability, Modifications & Third-Party Providers

No Service Level Agreement (SLA) The Service is provided on an "as available" and "as is" basis. We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of defects. We do not provide any service-level agreement (SLA), uptime guarantee, or commitment of any specific level of performance or availability, express or implied.

The Service depends on third-party Providers, payment processors, hosting infrastructure, and other third-party services that we do not control. We may change, suspend, or discontinue any feature, model, Provider, or aspect of the Service at any time, with or without notice. We may impose or change usage limits, rate limits, model availability, or pricing at any time. We will use commercially reasonable efforts to notify you of material changes via email or in-dashboard banner, but we are not obligated to do so.

Force Majeure. We shall not be liable for any delay, failure, or interruption in the Service caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government actions, pandemics, internet or telecommunications failures, cyberattacks, third-party service outages, or labor disputes.

10.AI Model Identification & Provider Liability

Model Names Are Labels — We Are Not Affiliated With Any Model Provider The names of AI models displayed on the Service (including but not limited to names such as "GPT-5.5", "GPT-4", "Claude", "Claude Opus", "Deepseek", "Gemini", or any other model name, version number, or branding) are labels, identifiers, or codenames used for routing purposes only. We do not represent, warrant, endorse, or claim any affiliation with OpenAI, Anthropic, Google, DeepSeek, Zhipu AI, Meta, Mistral, or any other company, organization, or person whose name, trademark, or product name may resemble a model name displayed on the Service. The Service is a routing, management, and aggregation layer only. We do not develop, train, fine-tune, evaluate, host, or directly control any AI model made available through the Service. All AI inference is performed by independent, third-party inference providers whose identity, behavior, accuracy, and availability we do not control.

No Endorsement of Model Behavior. We make no representation or warranty, express or implied, regarding the identity, behavior, capabilities, accuracy, safety, bias, performance, or any other characteristic of any model made available through the Service. The actual behavior of any model is determined solely by the underlying third-party inference provider and may change at any time, with or without notice, including but not limited to changes in model output, model availability, model identity, model naming, or model safety properties. A model that produces safe outputs today may produce unsafe outputs tomorrow, and vice versa, without notice to us or to you.

Provider Errors, Downtime, and Failures. The Service depends on third-party inference providers, payment processors, and other service providers that we do not control. We are not responsible for any failure, error, downtime, latency, or unavailability of any third-party provider, including but not limited to: (a) provider API outages or rate-limiting, (b) provider model deprecation or removal, (c) provider account suspension or termination, (d) provider changes to pricing, terms, or technical interface, (e) network failures between our servers and provider servers, (f) provider security incidents, or (g) any other failure of a third-party service on which the Service depends. In the event of a provider failure, our sole obligation is to use commercially reasonable efforts to restore service or switch to an alternative provider; we do not guarantee the availability of any specific provider or model.

No Guarantee of Model Origin or Authenticity. We do not warrant or represent that any model made available through the Service is, in fact, the model identified by its name, nor that it is produced by, affiliated with, or endorsed by any person or company whose name, trademark, or product resembles the model name. The underlying provider may, at any time and without notice to us, change the model served under a given name, redirect requests to a different model, or impersonate a model name for any reason, including but not limited to A/B testing, cost optimization, or service changes. You should not rely on the identity of a model as represented by its name for any purpose, including but not limited to legal, contractual, regulatory, or compliance purposes.

Provider Account and Credential Risk. The Service requires valid credentials with one or more third-party inference providers. If any such provider suspends, terminates, or revokes our account, or if our credentials are compromised, leaked, or otherwise invalidated, the Service may be partially or completely unavailable until the issue is resolved. We will use commercially reasonable efforts to maintain valid credentials with multiple providers as a redundancy measure, but we do not guarantee uninterrupted service in the event of a provider credential failure.

11.AI Model Outputs Disclaimer

Not Professional Advice Outputs generated by AI models accessed through the Service are produced by third-party artificial intelligence systems that we do not own, develop, or directly control. Such Outputs may contain errors, omissions, hallucinations, biases, or inaccuracies. Outputs are provided for informational and exploratory purposes only and do not constitute professional advice of any kind, including but not limited to legal, medical, financial, accounting, tax, engineering, or other professional advice. You should not rely on Outputs as a substitute for professional advice tailored to your specific circumstances. Always consult a qualified professional before making decisions based on Outputs.

You are solely responsible for reviewing, evaluating, and verifying the accuracy and appropriateness of any Output before relying on it for any purpose. We make no warranty or representation, express or implied, regarding the accuracy, completeness, reliability, or fitness for any particular purpose of any Output.

Because AI models may produce substantially similar Outputs for similar inputs, we do not guarantee that any Output is unique to you, and we disclaim any ownership or copyright in the Outputs to the maximum extent permitted by applicable law.

12.Suspension, Termination & Account Actions

We reserve the right, at our sole discretion and without prior notice, to:

Grounds for suspension or termination include, without limitation: violation of these Terms; abusive or fraudulent behavior; non-payment; chargebacks initiated in bad faith; multi-account abuse; suspected automated or bot activity; or activity that we reasonably believe may harm the Service, other users, or third parties.

Effect of Termination. Upon termination, your right to use the Service ceases immediately. We may delete your account data, API Keys, and associated records, subject to our data-retention practices described in the Privacy Policy. Sections of these Terms that by their nature should survive termination (including but not limited to Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution) shall survive.

No Refund on Termination for Cause. If your account is terminated for violation of these Terms or for abusive behavior, you are not entitled to any refund of fees paid, and any unused bonus credits or promotional credits are forfeited.

13.Intellectual Property Rights

The Service, including its source code, design, text, graphics, logos, icons, images, audio, video, software, and all related intellectual property, is and shall remain the exclusive property of Atlas Gateway and its licensors. Except as expressly stated in these Terms, no part of the Service may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without our prior written consent.

Trademarks, service marks, and trade names (including but not limited to "Atlas Gateway") are proprietary to us. You may not use any such marks without our prior written consent. All other trademarks appearing on the Service are the property of their respective owners.

14.Disclaimers & No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE (INCLUDING ALL CONTENT, FEATURES, FUNCTIONS, AND OUTPUTS) IS PROVIDED ON AN "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS" BASIS. ATLAS GATEWAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS (COLLECTIVELY, THE "ATLAS GATEWAY PARTIES") EXPRESSLY DISCLAIM ALL REPRESENTATIONS, WARRANTIES, AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

15.Limitation of Liability

Important — Please Read TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE ATLAS GATEWAY PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES), ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE, ANY CONTENT OR OUTPUT OBTAINED THROUGH THE SERVICE, ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, OR ANY OTHER MATTER RELATING TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Cap on Liability. IN ANY EVENT, THE TOTAL CUMULATIVE LIABILITY OF THE ATLAS GATEWAY PARTIES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.00.

THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

16.Indemnification

You agree to defend, indemnify, and hold harmless the Atlas Gateway Parties from and against any and all claims, demands, actions, suits, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; (d) Your Content; or (e) any claim that your use of the Service has caused damage to a third party.

17.Dispute Resolution & Arbitration

Informal Resolution. Before initiating any formal dispute, you agree to first contact us at support@atlasbrain.cloud or atlascore.pk@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute by contacting you via email. If a dispute is not resolved within 30 days of submission, you or we may initiate formal proceedings.

Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the Singapore International Arbitration Centre (SIAC) under its then-current rules. The seat of arbitration shall be Singapore. The language of arbitration shall be English. The award of the arbitrator shall be final and binding.

Class Action Waiver. YOU AND ATLAS GATEWAY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF THIS CLASS-ACTION WAIVER IS HELD UNENFORCEABLE, THEN THE ENTIRETY OF THIS ARBITRATION SECTION SHALL BE NULL AND VOID.

Governing Law. These Terms shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any conflict-of-laws principles. Notwithstanding the foregoing, the arbitration clause above shall be governed by the Singapore International Arbitration Act.

Injunctive Relief. Notwithstanding the foregoing, either party may seek temporary or preliminary injunctive relief from a court of competent jurisdiction in aid of arbitration.

18.Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email (to the address associated with your account) and/or an in-dashboard banner at least 14 days before the changes take effect. Non-material changes (such as clarifications, typographical corrections, or changes to contact information) may take effect immediately upon posting.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may close your account by contacting us at support@atlasbrain.cloud or atlascore.pk@gmail.com.

19. Miscellaneous

Entire Agreement. These Terms (together with the Privacy Policy and Refund Policy) constitute the entire agreement between you and Atlas Gateway regarding the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected, and the invalid provision shall be replaced by an enforceable provision that most closely reflects the parties' original intent.

No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any successor, acquirer, or affiliate without notice.

Headings. Section headings are for convenience only and do not affect interpretation.
